PAWGUST Terms & Conditions
These terms and conditions apply to organisations, groups and individuals (you or your) that are planning to fundraise on behalf of Blind Low Vision New Zealand for the purposes of participating in PAWGUST. By registering for the PAWGUST challenge, you agree to comply with and be bound by these terms and conditions. If you have any questions, please call 0800 120 254 and we will be more than happy to assist you.

Upon completing your registration, Blind Low Vision New Zealand will automatically approve your event/activity associated with fundraising for PAWGUST.

You must be registered with us and have received our registration confirmation email before you start any fundraising. You may fundraise during the PAWGUST campaign period only, being from 13th May 2025 to 30th September 2025 of the calendar year in which you have registered to participate.

If you wish to extend or change any aspect of your fundraising event/activity you will need to seek additional approval from. Blind Low Vision New Zealand retains the right to revoke approval of any fundraising event/activity you engage in.

You are responsible for ensuring that your event/activity is conducted in accordance with relevant charities’ legislation and or regulations in New Zealand which the fundraising activity is being held, and you must obtain any permits, authorities, licences and insurances needed. For example, permits are required by Councils and shopping centres for events in their area/on their premises and permits may also be required for the conduct of raffles or prize draws. If you require guidance in this area, please phone Blind Low Vision New Zealand. However, Blind Low Vision New Zealand cannot provide any legal advice to you and will not be liable for any breach of any relevant legislation, regulation or rule applicable to your fundraising event/activity.

You are responsible for ensuring the safety of your event/activity, including the safety of your volunteers and personnel including, but not limited to, organising appropriate public liability insurance and providing first aid services if required. Blind Low Vision New Zealand insurance policy does not cover events conducted by external organisations/individuals.

Any use of our trade marks, logos, text, images, name or any other branding must first be approved by us. Please contact us.

All publicity in reference to your fundraising event/activity should clearly state that the event/activity is being organised by you. All promotional material must be worded in such a way as to make it clear that Blind Low Vision New Zealand is not the organiser of your fundraising event/activity but that it is either the only beneficiary, or is one of a number of charities benefiting from the event.

You must make it clear in any dealings with the public, donors, sponsors and supporters that you are not our agent or representative but are acting on your own behalf to raise money for Blind Low Vision New Zealand.

You are responsible to ensure that all funds raised from the public on behalf of Blind Low Vision New Zealand until the fundraising event/activity is completed are kept by you in a secure place. If you raise funds offline (ie. not on your online fundraising page provided to you), you are further responsible to ensure that you maintain complete and accurate records of income received and expenses incurred (if any) as part of your event/activity and that these are sent to Blind Low Vision New Zealand within seven (7) days of the fundraising event/activity taking place. If your offline fundraising involves the collection of a donor’s personal data, including donor credit card information, you are responsible for ensuring that data is kept private and secure, not transmitted via unsecured channels, and is destroyed securely after being processed.

All costs and debts associated with your fundraising event/activity are your responsibility and we will not be liable for any financial loss suffered by you or those involved.

You acknowledge that only Blind Low Vision New Zealand is authorised, in its sole and absolute discretion, to allocate donated funds within Blind Low Vision New Zealand.

You must not approach the general public with door-to-door, street or telephone collections as part of your fundraising event/activity.

As part of your fundraising event/activity, we encourage you to use social media to promote your involvement as a participant in PAWGUST. In order for our event marketing personnel to more accurately track social media presence, please use the hashtags #PAWGUST2025 #PAWGUST (Campaign Hashtags) on all social media posts concerning the PAWGUST event. Any images or posts posted on the internet which include any of the Campaign Hashtags must not contain anything that (Prohibited Content):

looks like spam or advertising;

defames, abuses, harasses, threatens or otherwise violates the legal rights of others;

may be seen to contain discriminatory or vilifying content;

includes any obscene, indecent, fraudulent, deceptive, misleading or unlawful material or information; or
-
violates the intellectual property rights of others.
Blind Low Vision New Zealand retains the right to request removal of any posts which include any of the Campaign Hashtags which Blind Low Vision New Zealand considers, in its absolute discretion, to be in breach of the Prohibited Content. If you do not comply with such a request in a timely manner, Blind Low Vision New Zealand may, in its sole and absolute discretion, take whatever action it deems necessary.
By participating in PAWGUST and posting images to social media together with the Campaign Hashtags, you hereby grant Blind Low Vision New Zealand a non-exclusive, royalty-free, perpetual and irrevocable licence to use your images for the purposes of advertisement and promotion of PAWGUST.

If you are planning to involve children in your fundraising event/activity you will be required to comply with further guidelines from Blind Low Vision New Zealand. Please contact Blind Low Vision New Zealand directly for further information.

If you have any prior or current criminal convictions, you must disclose these to Blind Low Vision New Zealand before participating in PAWGUST. Please contact us via the details on page 11 of this document. Although these will not necessarily stop you from being able to support Blind Low Vision New Zealand, they will be taken into account in agreeing to your suitability as a participant.

We may at any time, without the need to give any reasons, withdraw your registration in PAWGUST by notification in writing.

By registering online for PAWGUST you agree to our PAWGUST Privacy Policy, which is set out on the following pages.

It is a condition of PAWGUST that by registering online, you are confirming that you are aged 18 years or over and consent to receiving marketing materials relating to PAWGUST and broader Blind Low Vision New Zealand communications.

To the maximum extent permitted by law, Blind Low Vision New Zealand does not accept any liability for any loss or damage (including but not limited to personal injury; death; indirect, consequential, incidental, special, exemplary or punitive loss or damage) which you, or your pet or a third party may suffer or incur as a result of your participation in PAWGUST. You release Blind Low Vision New Zealand to the maximum extent permitted by law for all claims and demands of any kind associated with: (a) your fundraising event/activity in relation to PAWGUST; and/or (b) your pet’s health and wellbeing throughout the event or as a result of the event in relation to PAWGUST. You also agree to indemnify Blind Low Vision New Zealand for all liability or costs that may arise in respect of any damage, loss or injury occurring to any person or animals in any way associated with: (a) your fundraising event/activity in relation to PAWGUST; and/or (b) the PAWGUST challenge.
Online Activity and Social Media
We use Google Analytics to track visits to our website, and use this information to track the effectiveness of our website, including number of visits, length of visit, viewed pages and the technical capabilities of our visitors. While this data is mostly anonymous, sometimes we will connect it to you, for instance in personalising a webpage, or pre-filling a form with your details. We also use tools that tell us when a computer or device has visited or accessed our content, which allows us to tailor advertising both on our websites and through advertising networks on other websites based on your visits or behaviour through cookies on your device. You can control how cookies are used by accessing the settings on your chosen browser.
You can also engage with Blind Low Vision New Zealand through social media, including Facebook, Twitter, Instagram etc. You can always control how you receive content through each website’s settings. Occasionally, we may get in touch with you via social media if you are not already a follower by using the details on your record, such as your email address. PAWGUST Privacy Policy
Blind Low Vision NZ is committed to protecting your privacy. This privacy statement outlines what personal information and health information we collect, use and disclose in accordance with the Privacy Act 2020 and Health Information Privacy Code 1994.
Blind Low Vision NZ collects information for different purposes. This Privacy Statement is a general privacy policy. It addresses collection of information via our website and electronic communications. In other contexts, such as the provision of services or collection of employment related information, more detail about the management of personal information will be provided.

The information we collect?
Blind Low Vision NZ collects information about our supporters, donors, clients and website users, including:

Personal and health information that you provide voluntarily when completing forms, such as enquiring about Blind Low Vision NZ services, making a donation, or enquiring about volunteer or work opportunities.

Website usage information through tracking your individual click behaviour.

Aggregated website traffic information collected by our web server or third party systems we subscribe to.

Through the recording of your image on CCTV footage in and around some of our offices.

Aggregated data: this information is generated by our systems as they track traffic through our website. This information does not identify you personally and is not linked to the personally identifiable information that you may have provided.
When we send emails, we may track behaviour such as who opened the emails and who clicked links. This allows us to measure the performance of our email campaigns and to improve their relevance and content.
Wherever possible information is collected directly from the individual themselves. You are not obliged to provide information although, without it, we may not be able to provide the response or services requested. Sometimes it is necessary to collect information from others such as a treating health practitioner or a family member. We will discuss with you the services sought and the kind of information required to provide those services.
Who do we share this information with?

The aggregated data (not sensitive health information or personally identifiable information) may be shared with third parties such as advertisers or business partners.

Your personally identifiable information may be shared with third parties when we are authorised or required to do so by law – for example you may consent to disclosure.

Blind Low Vision NZ sometimes employs contractors, service providers and other third parties to perform functions on our behalf. Examples include print service providers, mail houses and major delivery companies. They have access to the limited personal information needed to perform their functions, but may not keep, use or disclose it for other unauthorised purposes. Our agreements with them protect the information that we collect from any unauthorised use.

If you are eligible to receive services from Blind Low Vision NZ, we will share your contact details with blindness consumer organisations that provide advocacy services and support – unless you ask us not to.

We may disclose your information where disclosure is directly related to the purpose for collection of the information. We will not share your personal information with any other third parties unless legally authorised to do so, for example, where you give your permission.
How do we use the information?
We have collected your personal information and/or health information in order to provide the best possible service to you. To this end, we may use the information that you provide for the following purposes, depending on the context in which it is provided:

Giving you control – Communications from Blind Low Vision New Zealand?
Blind Low Vision NZ communicates with clients, donors and others through different media, depending on the context. Communication occurs in many ways, including face-to-face, by telephone, letter, email, text and by social media. Methods of communication change over time, but ensuring safe transmission of personal information is important to us.
Sensitive personal information such as clinical details will only be requested or disclosed by secure means such as direct discussion or letter. Less sensitive information, such as an appointment reminder, may be sent by text unless you specify otherwise. General communications, such as notification of public events, may be communicated by social media. We will assume that, where you have provided contact details, the particular form of communication is acceptable, unless you specify otherwise. Please let us know if you have any request or concern regarding how we communicate with you.
From time to time, Blind Low Vision NZ will send you communication that we feel is appropriate to the nature of your relationship with us. For example, if you are receiving services from us, you will receive information about services that may be of interest to you. If you donate to us then you will receive information about how your donations are having an impact and future donation appeals. If you are a voting member of Blind Low Vision NZ, you will receive information related to governance.
Any group electronic communication we send you (for example, either by email or text), except for messages confirming a transaction with us or a one-on-one communication, will always have an unsubscribe facility.
If at any stage you feel that you are receiving communications of any kind from us that you do not want, please call us on 0800 24 33 33 and let us know. NB: If you wish to reduce all unsolicited mail or phone calls, you can register with the Marketing Association’s service.
What about cookies?
A cookie is a small file that resides on your computer and is recognised by our server when you visit our site. A cookie does not provide us with any personally identifiable information. It does provide details of your IP address, the computer platform that you use (e.g. Mac or Windows), the browser that you use (e.g. Microsoft Explorer or Netscape) and what domain you are accessing our sites from. It helps Blind Low Vision NZ by:

If you would rather we did not use cookies with you, you can refuse them by turning them off in your browser and/or deleting them from your hard drive. You will still be able to visit our site.
What about third-party Cookies
Third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimise, and serve ads on the internet based on someone’s past visits to our website. Personally identifiable information is not stored by us or any third-parties.
You are free to opt out of Google’s use of cookies by visiting Google’s Opt Out page. Alternatively, you can opt out of a third-party vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page.
We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimisation, fraud/security purposes, and advertising. Information security
We work diligently to protect the security of your personal information, including credit and debit card information.
Our servers are protected by appropriate controls, user authentication protocols, and so on. Our personnel are permitted to access information related to the work they undertake.
When you submit personal information including credit card details, a secure server is used. We protect your information during transmission by using the Secure Sockets Layer (SSL) protocol, which encrypts your information when transmitted over the Internet. You can check that the SSL is active by looking for the padlock symbol on many browsers.
We also follow the PCI (Payment Card Industry Data Security Standards) protocol. i.e. we meet all PCI requirements to ensure that we process, store or transmit credit card information securely.
It is important for you to protect against unauthorised access to your password and to your computer. We recommend that you logout when you have finished, especially if using a shared computer.

Requesting Deletion of Data
If you would like to request for your data to be deleted, please email info@pawgust.co.nz citing your name and email address.
Legal and policy framework governing your information
Blind Low Vision NZ is governed by the Privacy Act (2020), the Health Information Privacy Code (1994), the New Zealand Public Health and Disability Act (2000) and the Health and Disability Commissioner Code of Health and Disability Services Consumers’ Rights Regulations (1996).
